Terms & Conditions

A. The Prize

  1. The main purpose of the Prize Draw is for one Entrant to win Kisiwa Kitau (Owner’s evaluation: £450,000) & £400,000 cash as the Main Prize. Further details regarding the Prize can be found on the Promoter’s Website.
  2. The Main Prize, Kisiwa Kitau & £400,000 cash will be awarded free of any mortgages, encumbrances and land taxes or registration fees liable in the UK, if the minimum number of tickets are sold.
  3. Location of Kisiwa Kitau: Manda Island, Lamu, Kenya.
  4. The Owner’s evaluation of Kisiwa Kitau with the beach house built is approximately £3,500,000.
  5. The winning ticket holder is responsible for claiming their £400,000 cash reward as taxable income.
  6. The Promoter will pay the relevant tax on behalf of the winner for the £400,000 cash prize up to £180,000. This will be added to the total cash prize reward to ensure they are left with £400,000 cash in total.
  7. The Promoter will notify HMRC of the winning Entrant, it is the Entrant’s responsibility to inform the Promoter of the tax costs. Proof will be required.
  8. If the winning ticket holder is from outside the UK, the Promoter will pay tax based on UK rates: Up to £180,000.
  9. Any cash prize reward offered outside of the main prize (£400,000 to build a beach house) will be the Entrant’s responsibility to pay tax on, this includes the cash prize alternative.
  10. The Entrant acknowledges and accepts that if fewer than the minimum number of tickets are sold the winner will be awarded an Alternative Prize, consisting of the cash equivalent of the total number of tickets sold, minus reasonable costs, not to exceed 50% of net payments.
  11. 10,000 tickets sold – £50,000 Cash Prize
  12. 50,000 tickets sold – £250,000 Cash Prize
  13. 100,000 tickets sold – £500,000 Cash Prize
  14. 150,000 tickets sold – £750,000 Cash Prize
  15. 200,000 tickets sold – £1,000,000 Cash Prize
  16. 250,000 tickets sold – £1,250,000 Cash Prize
  17. 300,000 tickets sold – £1,500,000 Cash Prize
  18. 350,000+ tickets sold – Kisiwa Kitau & £400,000 cash guaranteed to be awarded. The total prize value is an estimated £3.5 million.
  19. The Promoter reserves the right to end the Prize Draw if it proves to be unviable, in which case The Alternative Prize will be offered.
  20. The £400,000 cash prize is intended to be used to build an 8 bedroom beach house as outlined on the Promoter’s Website; however, the winner can choose to spend the cash prize on whatever they wish.
  21. The £400,000 cash prize covers the cost of the building, fixtures, fittings, furniture and landscaping. The Promoter is allowing 10% contingency for unforeseen costs.
  22. The Promoter will issue a statement on the website informing all entrants that Kisiwa Kitau & the £400,000 cash is confirmed as the prize when the minimum number of tickets has been reached.
  23. The Promoter is responsible for changing the title deeds with Ministry of Lands, Nairobi.
  24. Stamp duty, together with solicitors fees and associated charges will be paid for by the Promoter. The Promoter will pay a maximum £25,000 towards this.
  25. If the minimum number of paid Entries has been reached, the Promoter will announce the name of the Entrant who generated the most ticket sales through sharing their personalised URL link. This individual will be awarded a £10,000 cash prize. If the actual number of tickets sold is less than the Minimum Paid Entries required to award Kisiwa Kitau & the £400,000 cash prize, the Promoter will not award the £10,000 cash prize.  
  26. ) If the Entrant has purchased more than one ticket, only the highest ranking referral link will be considered, Entrants will not have an accumulative score through each unique URL.
  27. ) Entrants do not have to take part in the referral scheme.
  28. ) The referral scheme will close on the Prize Draw closing date.
  29. ) The winner will be announced within 28 days of the Prize Draw closing date.
  30. ) It is the Entrant’s responsibility to claim and pay tax on their awarded prize.
  31. ) If there are Entrants with an equal number of referrals by the closing date then a prize draw will be made to determine the winner of the £10,000.
 

B. Holiday give-away

  1. The Promoter will be giving away 7 holidays for two people to visit Kisiwa Kitau at different ticket sale stages throughout the Prize Draw.
  2. 10,000 tickets sold – 1st Holiday drawn.
  3. 50,000 tickets sold – 2nd Holiday drawn.
  4. 100,000 tickets sold – 3rd Holiday drawn.
  5. 150,000 tickets sold – 4th Holiday drawn.
  6. 200,000 tickets sold – 5th Holiday drawn.
  7. 250,000 tickets sold – 6th Holiday drawn.
  8. 300,000 tickets sold – 7th Holiday drawn.
  9. All individual paid/posted entries will be placed in this additional prize draw automatically.
  10. The winning ticket holder will win a Holiday for 2 people to Kenya to visit Kisiwa Kitau in the Lamu Archipelago for seven nights.
  11. The prize will include flights and accommodation between the Kizingo Beach Lodge and the Majlis Beach Resort (subject to availability).
  12. Entrants will have as many entries in the Holiday prize draw as they do in the main prize draw.
  13. Entrants can only win 1 out of the 7 Holidays available.
  14. The winning ticket holder will be contacted within 28 days of being drawn.
  15. The Holiday must be redeemed within 4 weeks (Subject to Covid-19 restrictions).
  16. If the winning ticket holder is unable to accept the dates provided for the Holiday for any reason, the prize will be re-drawn.
  17. The winning ticket holders are expected to cooperate in providing promotional marketing material for this Prize Draw. This may include announcing the winning Entrant on Radio.
  18. WinMyParadise will arrange all visas for the Holiday winners.
  19. Due to the on-going Covid-19 pandemic, the Holidays will only take place if it’s within government guidelines. In the event of not being able to travel due to Covid-19, the holiday will simply be postponed.
  20. If travel is open but there are quarantine restrictions in place upon return to the winner’s country of residence, they must be prepared to quarantine if Holiday dates are provided.

C. The Prize Draw

  1. The price to enter the Prize Draw is £11.00 GBP per Entry, and is payable via the Website. All payments must be made through the Promoter’s chosen payment Gateways, and must adhere to the Gateways’ Terms and Conditions. Alternatively Postal Entries can be made free of charge on a postcard, as outlined in the Terms and Conditions. 
  2. Valid Postal Entries must be submitted in English and include:
  3. ) The Entrant’s contact information (full name, full address, phone number, email address).
  4. ) A 1st class stamped postcard
  5. The full and correct details must be included on a postal entry as well as the PO box address (this is displayed on the free entry page). The correct details must be included for the postal entry to be accepted.
  6. Postal entries received from outside the United Kingdom will not be accepted.
  7. The Promoter will allow 3 days from the final closing date for free entries to arrive.
  8. The process to determine the winner will begin once all free postal entries have been received three days after the final closing date. 
  9. Entries made via www.winmyparadise.com; Upon providing contact information, the Entrant will provide payment information (for example credit or debit card information), and payment will be taken from the Entrant for the number of Entries they have selected to purchase. Payment will be electronically approved and the Entrant will be sent an electronic receipt via email.
  10. The Entrant acknowledges that Entries, purchased or sent by post, are only submitted to the final prize and Holiday prize draw if all of the correct details have been provided. The Promoter’s decision is final.
  11. The Prize Draw will close on the Closing Date.
  12. The Winner will be drawn, announced and contacted within 28 days of the closing date of the Prize Draw.
  13. The Promoter will draw the winner at random using an online random number generating algorithm and is therefore completely secure and random. It will also take place under the supervision of Licensing Lawyers.
  14. Once the Winner has been chosen, the Promoter’s decision is final and no further correspondence will be engaged in regarding the result of the Prize Draw.
  15. The Promoter will attempt to contact the Winner by phone and email. If after 28 days the Promoter has been unable to make contact, or the contact details provided are incorrect, the Winner forfeits their right to the Prize and the ability to be included in any further draw. The Promoter will then undertake a new draw to determine a new Winner. This process will continue until a Winner has been contacted and successfully confirmed their identity with the Promoter.
  16. The Winner agrees to provide a copy of their passport or driving licence (or equivalent ID) to confirm their identity. 
  17. The Winner may be required to travel to the Promoter’s nominated solicitors offices within 28 days of accepting the Prize in order to sign a sale agreement and deed transfer document.
  18. The Promoter will not be held liable if the Entrant enters the Prize Draw unlawfully. The Entrant acknowledges they are solely responsible for ensuring they do not contravene any law in their country of residence by entering or accepting the prize in this Prize Draw.

D. The Promoter

  1. The Promoter of the WinMyParadise prize draw is UK citizen, Karl Knight.
  2. The Promoter is contable at Kisiwa Kitau, PO Box 288, Leeds, LS12 9FD.
  3. The Promoter reserves the right to amend these Terms and Conditions at any time. All Prize Draw participants shall be notified of any changes and will have a period of 14 days to object to any amendments or request a full refund of the ticket.
  4. The Promoter is not responsible or liable for the valuations made and does not give warranty for the accuracy.
  5. The Promoter will not be liable for any entrant who enters the draw unlawfully.

E. Opening The Prize Draw

  1. The Prize Draw is open to entries on 1st October 2020 via the website or post.
  2. This Prize Draw was briefly started in December 2019 but suspended at the end of March 2020 due to Covid-19. All entrants during this time will be carried over to the new Prize Draw.

F. Closing The Prize Draw

  1. The Prize Draw ends on the Closing Date, 30th September 2021, at Midnight.
  2. If the Minimum number of Paid Entries has been reached, the Winner will be chosen as outlined in these Terms and Kisiwa Kitau and the £400,000 cash will be awarded as the Prize.
  3. If the Minimum Number of Paid Entries has not been reached by the Closing Date, then an “Alternative Prize” will be awarded in place of the Prize.
  4. The “Alternative Prize” will consist of a cash prize amounting to the total money generated by Paid Entries, minus administrative costs retained by the Promoters as outlined in section A.
  5. The Promoter will choose the Winner of the “Alternative Prize” in the same manner stipulated as for the Prize.
  6. The Promoter will allow 3 days from the final closing date for free postal entries to arrive.

G. General Prize Draw Terms

  1. By entering the Prize Draw, the Entrant understands these Terms and Conditions as outlined below and agrees to be bound by them.
  2. The Entrant is solely responsible for providing their correct contact information to the Promoter. The Promoter is not liable for any inability to contact the Entrant due to inaccurate contact information provided by the Entrant or otherwise. If the Promoter is unable to contact the Winner of the Prize Draw due to inaccurate contact information, the Winner will forfeit their right to the Prize and the Promoter will choose a new Winner.
  3. The Prize Draw is run by the Promoter.
  4. An Entrant can only enter the Prize Draw for themselves and not on anyone’s behalf.
  5. The Entrant agrees to provide their contact details as required by the Promoter. The Promoter agrees to comply with the current Data Protection laws and use these details only for the following purposes:
  6. ) To notify/keep the Entrants updated with any news, changes or developments in the Prize Draw.
  7. ) To inform the Winner they have won the Prize
  8. ) To announce the Winner on the website and corresponding social media/radio outlets
  9. The Entrant agrees to allow the Promoter to store and use their contact information and any other personal data collected in accordance with the Data Protection Act 2018, for the purpose of running the Website and Prize Draw.
  10. The Entrant agrees to allow the Promoter to share their contact information and personal data provided to relevant third parties for the purpose of preventing fraud, money laundering, or any other legal or regulatory reasons.
  11. The Prize Draw is open to anyone aged 18 or over, excluding the Promoter, employees, immediate family, servants and agents.
  12. Valid Entries must be submitted via the Website www.winmyparadise.com or by post.
  13. All postal entries are free of charge. Each Postal Entry must be submitted on an individual postcard and sent with a first-class stamp. Each postcard must contain the Entrant’s full name, address, telephone number and email address. Entry postcards sent in envelopes will not be accepted and the Entries will be void.
  14. On entering the Prize Draw, the Entrant acknowledges that payment of £11.00 GBP per Entry (or submitting a free entry) does not in any way guarantee they will win the Prize.
  15. The Price of £11.00 GBP per Entry is set by the Promoter and all payments must be made in Pound Sterling. Alternatively, you can enter for free by post as detailed above.
  16. Each Entry to the Prize Draw entitles the Entrant to one chance to win the prize; for example, 20 Entries gives the Entrant 20 chances to win the Prize.
  17. Only completed Entries made in accordance to these Terms and Conditions will be admitted to the final prize draw. Please see www.winmyparadise.com for more details.
  18. The Promoter agrees to ensure that all Entries, paid or free, are treated equally by the Promoter, as long as all other conditions are met.
  19. The Promoter will not be held liable if the Entrant enters the Prize Draw unlawfully. The Entrant acknowledges they are solely responsible for ensuring they do not contravene any law in their country of residence by entering or accepting the prize in this Prize Draw.
  20. The Entrant acknowledges the Promoter’s right to disqualify, entirely at their own discretion, any Entrant or Entry, in the event that the Terms and Conditions are breached, including but not limited to inaccurate or untrue information being submitted.
  21. All Entries automatically become property of the Promoter upon receipt and will not be returned.
  22. There is no limit to the number of Entries that can be made by any one person (website entries are 10 entries per transaction, an unlimited number of transactions can be made) but all Entries must adhere to the aforementioned Terms and Conditions. Postcard entries count as 1 entry per post card received.
  23. The Promoter reserves the right to amend these Terms and Conditions at any time. All Prize Draw participants shall be notified of any changes and will have a period of 14 days to object to any amendments or request a full refund of the ticket.
  24. If the Winner is or becomes ineligible to win the prize, fails to comply with the terms and conditions or cannot proceed with completion of the transfer of Kisiwa Kitau within 3 calendar months from the date of the draw, an alternate winner will be chosen in the same way that the winner was selected.
  25. The Promoters and Entrants recognise that the conditions under which the Prize Draw is run are governed by English Law, and that in the event of any dispute, the County and High Courts have sole jurisdiction.
  26. The Promoter reserves the right to the usual 28 days to hand over the ownership to the Winner (28 days starts once the Winner has acknowledged their prize).
  27. The winning entrant will be required to provide bank details for the transfer of the £400,000 cash prize. The transfer will take place within 28 days (28 days starts once the Winner has acknowledged their prize). The winning entrant must adhere to their tax obligations before this can be done as outlined in section A.
  28. The Prize Draw rules do not form any contract nor venture between the Promoters and Entrants.
  29. All Sheldrick Wildlife Trust donations will be paid quarterly to the charity.

H. Secondary Promotions

  1. ‘Secondary Promotions’ refers to any prizes awarded outside of the main prize (Kisiwa Kiatu + £400,000) & the Holiday giveaways.
  2. Entrants who partake in the main WMP prize draw will be automatically entered into the Secondary Promotion, unless otherwise stated in the rules of the applicable Secondary Promotion.
  3. Rules in how to enter the Secondary Promotions will be announced on the WMP website & social media and may differ with each prize giveaway.
  4. All Entrants in the main WinMyParadise prize draw will receive the same number of entries into the Secondary Promotion(s) as long they adhere to the full rules of the applicable Secondary Promotion, regardless of their chosen method of entry.
  5. All prizes advertised are subject to availability.
  6. All Secondary Promotion prizes are subject to one per Entrant.
  7. Winners will be chosen using an online random number generating algorithm and is therefore completely secure and random.
  8. Secondary Promotion Winners will be announced on the WinMyParadise social media page and website.
  9. Winners are expected to cooperate in providing promotional marketing material for WinMyParadise, this may include images, videos & quotes before and after they have received the prize.
  10. The winner will be contacted within 7 days of being drawn.
  11. The prize will be sent to the winner via direct post once a delivery address has been agreed with the winner.
  12. Postal entries will be accepted up to three working days after the closing date. Entrants who make entries this way must still comply with the full entry instructions announced on the website and social media.
  13. WinMyParadise is not responsible for any post office/delivery delays or errors.
  14. Entrants for winners outside the UK must ensure they are allowed to accept this prize.
  15. If the winner is from outside the UK, they may be liable for import taxes, these costs will not be covered by WinMyParadise.
  16. Winners will be drawn from the Entrants in the WinMyParadise prize draw and checked to see that all secondary prize draw requirements have been met.
  17. If you have entered the WinMyParadise prize draw but we can not confirm you have complied with all the Secondary Promotion instructions, your entry will not count towards to the Secondary Promotion prize give-aways.
  18. WinMyParadise have the right to withdraw Secondary prize giveaways at any point. 

I. Other

  1. In the case of a force majeure event intervening in the Prize Draw, the Prize Draw may close and the prize be awarded or refunds provided to those who have paid to enter, at the discretion of the Promoter.
  2. Entrants agree that the usual requirements under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 for goods and services ordered online to be supplied within 14 days will not apply to this Prize Draw.
  3. The Promoter does not accept liability or responsibility in the event that Website Entries are not received due to failed computer communications or loss through use of the Promoter’s Website, including merchant transaction malfunctions, internet traffic, server faults, software or hardware malfunctions or any other reason. The Promoter does not accept responsibility for any Postal Entries not received due to delivery error or failure.
  4. The Promoters, employees and agents will not be liable for any loss, economic or otherwise, suffered to or sustained by any person or property as a result of any act or omission, during or following the distribution of the Prize to the Winner.
  5. Any Entry can be declared void, without refund if the Entrant:
  6. )engages in any kind of fraudulent activity to enter the Prize Draw, including but not limited to fraudulently misrepresenting themselves or the Promoter
  7. )hacks or interferes with the functioning or coding of the website
  8. None of the Terms and Conditions outlined above constitute a contract, joint venture or agreement between the Promoter and Entrant.
  9. All Entrants and Entries will be treated equally, as long as all conditions are met.
  10. All Entrants should retain a copy of these Terms and Conditions for their own records.
